PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THESE INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS, A CLAUSE THAT GOVERNS THE JURISDICTION AND VENUE OF DISPUTES, AND OBLIGATIONS TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS.
WyzFit ("WyzFit," "we," "us," or "our") does not provide medical, fitness, or other professional advice. You participate in exercise activities entirely at your own risk.
IMPORTANT NOTICE
By downloading, accessing, or using the application or services (as defined below), you agree to be bound by these Terms. These Terms include, in particular, the Privacy Policy and limitations on liability.
1. Contractual Relationship
These Terms of Use ("Terms") govern your access to and use of applications, websites, content, products, and services (collectively, the "Services") made available by WyzFit worldwide. PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.
Your access to and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and WyzFit. If you do not agree to these Terms, you may not access or use the Services. These Terms supersede all prior agreements or arrangements between you and WyzFit.
WyzFit may amend these Terms from time to time. Updated Terms will be posted and your continued use of the Services constitutes acceptance of the revised Terms.
You consent to WyzFit's collection and use of personal information in accordance with the WyzFit Privacy Policy.

2. The Services
The Services provide a technology platform that enables users to receive workout routines and fitness-related recommendations based on user inputs and activity data. THE SERVICES DO NOT CONSTITUTE PERSONAL TRAINING OR MEDICAL SERVICES. Any workouts or training routines are followed entirely at your own risk. You should consult a qualified professional before beginning any exercise program.
The Services are provided solely for personal, non-commercial use unless otherwise agreed in writing.
3. License
Subject to your compliance with these Terms, WyzFit grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for personal, non-commercial use. All rights not expressly granted are reserved by WyzFit.
4. Restrictions
You may not:
- Remove proprietary notices;
- Copy, modify, distribute, sell, or exploit the Services;
- Reverse engineer or attempt to extract source code;
- Scrape, index, or data-mine the Services;
- Attempt unauthorized access to any system related to the Services.
5. Provision of the Services
You acknowledge that the Services may be offered under the WyzFit brand and through affiliated entities. Availability of Services is not guaranteed.
6. Third-Party Services and Content

The Services may integrate or link to third-party services not controlled by WyzFit. WyzFit is not responsible for third-party content, products, or services. Use of third-party services is subject to their own terms and policies.
7. Ownership
All rights, title, and interest in and to the Services are owned by WyzFit or its licensors. These Terms do not grant you any ownership rights.
8. One-Time Payments and Subscriptions
Certain Services require payment. You may purchase access through a one-time payment or subscription.
All payments are non-refundable except within ten (10) calendar days of the initial purchase. Subscription fees renew automatically unless cancelled prior to renewal. You may cancel by contacting info@wyzfit.com. Cancellation becomes effective at the end of the current billing period.
9. Your Use of the Services
I. User Requirements
The Services are not intended for individuals under 18 years of age. You agree to comply with all applicable laws when using the Services.
II. User Content
You retain ownership of content you submit but grant WyzFit a perpetual, worldwide, royalty-free license to use, modify, distribute, and display such content in connection with the Services.
III. Network Access and Devices
You are responsible for obtaining compatible devices and network access. WyzFit does not guarantee uninterrupted or error-free service.

10. Disclaimers; Limitation of Liability; Indemnity
I. Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WYZFIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
II. Limitation of Liability
To the maximum extent permitted by law, WyzFit shall not be liable for indirect, incidental, or consequential damages. WyzFit's total liability shall not exceed the amount paid by you for the Services in the twelve (12) months preceding the claim.
III. No Medical Advice
The Services do not provide medical advice. No doctor-patient relationship is created.
IV. Indemnity
You agree to indemnify and hold harmless WyzFit from claims arising out of your use of the Services or violation of these Terms.
11. Dispute Resolution
Disputes shall be resolved through binding arbitration, except where prohibited by law. Arbitration shall be conducted in accordance with applicable arbitration rules.
12. Governing Law
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles.
